SUBJECT OF THE CONTRACT<\/p><p>1.1. In accordance with this agreement, Apart is obliged to provide the accommodation service in the Apartment upon the request of the Customer (hereinafter referred to as the &#8216;Service&#8217;).<\/p><p>1.2. With the signing of this contract (Customer accepts that he has signed this contract by making a reservation for accommodation in the Apartment and\/or the services offered by the Apartment), the Customer confirms that he has been informed about the accommodation rules, reservation rules and tariffs in the apartment.<\/p><p>1.3. When Apart confirms the Customer&#8217;s request (When the Reservation is Confirmed), the Parties will have concluded this contract.<\/p><p>2. FORM OF ACCOMMODATION RESERVATION<\/p><p>2.1. Service reservation can be made according to DAPHNE PERA availability, by completing the reservation form on the www.daphnepera.com website and sending it by paying 10% deposit.<\/p><p>2.2. In the event that the customer wishes to terminate his request or make any changes, he can apply to the apartment on +90 533 276 45 18, send an e-mail to the e-mail address herogunaydin@gmail.com or via whatsapp online on the Apart website, provided that he complies with the points specified in this contract and fulfills the conditions. can contact customer representatives in person.<\/p><p>2.3. 2.2. It must be sent to the apartment by one of the methods specified in the article.<\/p><p>2.4. The customer may request a date change for the reservation for once, depending on availability. The customer has to accept the price differences that may occur on the new reservation dates. If the customer wishes to cancel the reservation, the deposit received in advance is non-refundable.<\/p><p>2.5. With this contract, the Customer accepts, declares and undertakes that if he\/she makes\/desires to make changes in the reservation during the registration period (early reservation period etc.) The Customer has accepted that special discounts will not be valid for reservation changes made outside of the periods during which special discounts are applied during registration.<\/p><p>2.6. The Apart will respond to the customer&#8217;s request for changes within the period according to the availability of the apartment.<\/p><p>2.7. There will be at least one customer over the age of 18 in the apartment room. Persons under the age of 18 can stay, provided that they are accompanied by at least one adult.<\/p><p>2.8. Apart from the specified number of people, guests will not be accepted in the apartment. If this rule is not complied with, the customer will be held responsible for any penalties that may occur.<\/p><p>2.9. The customer is deemed to have already accepted the additional charges at https:\/\/www.daphnepera.com\/apartments\/.<\/p><p>3. PAYMENT METHOD<\/p><p>3.1. The customer who will stay in the apartment has to pay 10% of the accommodation cost as a deposit during the reservation application. The remaining accommodation fee will be paid at the time of entry to the apartment.<\/p><p>3.2. The invoice will be given to the Customer at the exit of the Apartment after receiving the service. Apart cannot be held responsible for not receiving the invoice.<\/p><p>4. PAYMENT RETURN AND CANCELLATION<\/p><p>4.1. In case the customer sends the cancellation request to the Apart with one of the methods in article 2.2, 20 (twenty) days before the date of entry to the Apartment, the reservation is canceled provided that the deposit payment made is not refunded. The customer has irrevocably accepted and declared that he has paid this amount to Apart as a penal clause. If value added tax is required for penal clauses and other compensations to be paid by the Customer pursuant to this contract, the customer is obliged to pay the applicable value added tax.<\/p><p>5. ACCOMMODATION<\/p><p>5.1. Age and identity of the Customer and accompanying persons will be checked at check-in. The customer accepts, declares and undertakes in advance the legal responsibilities that may arise due to the customer&#8217;s giving wrong information. The Customer will also cover the expenses that may arise due to this situation.<\/p><p>5.2. In case of damage to the items inside during the stay, the customer shall pay the cost at check-out. The customer is deemed to have already accepted the additional charges at https:\/\/www.daphnepera.com\/apartments\/.<\/p><p>5.3. The customer, no matter what time he arrives at the apartment, will settle into the room at the earliest at 15:30 on the day of entry to the apartment due to the pandemic, and that he will leave the room at 11:00 at the latest, no matter what time he will leave the apartment. agreed to pay for the service.<\/p><p>5.4. OTHER PROVISIONS<\/p><p>6.1. Unpredictable conditions such as adverse weather conditions, strike-lockout, terrorism, military action, flood, fire, etc. will be considered as force majeure. In the event of such situations, the apartment may not continue to serve.<\/p><p>6.2 The Customer accepts, declares and undertakes that the District Courts are authorized for the resolution of disputes arising in accordance with this contract.<\/p><p>6.3. F\u0131r\u0131n\u0131 Sokak 10\/1 \u015eehit Muhtar Mahallesi Beyo\u011flu-\u0130stanbul\/T\u00dcRK\u0130YE, qui sera d\u00e9nomm\u00e9e DAPHNE PERA dans les articles suivants, est Daphne Pera Aparts &#8211; Taksim ; ci-apr\u00e8s d\u00e9nomm\u00e9es les Parties.<\/p><p>Ces partis\u00a0; Consid\u00e9rant que ce contrat est une offre officielle, contient toutes les conditions pour la fourniture d&#8217;un service d&#8217;h\u00e9bergement payant, toutes les conditions \u00e9nonc\u00e9es ci-dessous sont contraignantes pour les parties, il se trouve sur le site Internet de www.daphnepera.com, et ne peut \u00eatre modifi\u00e9 par le client, ils ont conclu ce contrat dans les \u00e9l\u00e9ments suivants. .<\/p><p>1. OBJET DU CONTRAT<\/p><p>1.1. Conform\u00e9ment \u00e0 cet accord, Apart est tenu de fournir le service d&#8217;h\u00e9bergement dans l&#8217;Appartement \u00e0 la demande du Client (ci-apr\u00e8s d\u00e9nomm\u00e9 le \u00ab\u00a0Service\u00a0\u00bb).<\/p><p>1.2. Avec la signature de ce contrat (le Client accepte d&#8217;avoir sign\u00e9 ce contrat en effectuant une r\u00e9servation pour un h\u00e9bergement dans l&#8217;Appartement et\/ou les services propos\u00e9s par l&#8217;Appartement), le Client confirme qu&#8217;il a \u00e9t\u00e9 inform\u00e9 des r\u00e8gles d&#8217;h\u00e9bergement, des r\u00e8gles de r\u00e9servation et tarifs dans l&#8217;appartement.<\/p><p>1.3. Lorsque Apart aura confirm\u00e9 la demande du Client (Lorsque la R\u00e9servation est Confirm\u00e9e), les Parties auront conclu le pr\u00e9sent contrat.<\/p><p>2. FORME DE R\u00c9SERVATION D&#8217;H\u00c9BERGEMENT<\/p><p>2.1. La r\u00e9servation du service peut \u00eatre effectu\u00e9e selon la disponibilit\u00e9 de DAPHNE PERA, en remplissant le formulaire de r\u00e9servation sur le site www.daphnepera.com et en l&#8217;envoyant en versant un acompte de 10%.<\/p><p>2.2. Dans le cas o\u00f9 le client souhaite mettre fin \u00e0 sa demande ou apporter des modifications, il peut s&#8217;adresser \u00e0 l&#8217;appartement au +90 533 276 45 18, envoyer un e-mail \u00e0 l&#8217;adresse e-mail herogunaydin@gmail.com ou via WhatsApp en ligne sur le site Apart, sous r\u00e9serve qu&#8217;il respecte les points pr\u00e9cis\u00e9s dans le pr\u00e9sent contrat et en remplisse les conditions, peut contacter personnellement les charg\u00e9s de client\u00e8le.<\/p><p>2.3. 2.2. Il doit \u00eatre envoy\u00e9 \u00e0 l&#8217;appartement par l&#8217;un des moyens sp\u00e9cifi\u00e9s dans l&#8217;article.<\/p><p>2.4. Le client peut demander un changement de date pour la r\u00e9servation pour une fois, en fonction des disponibilit\u00e9s. Le client doit accepter les diff\u00e9rences de prix qui peuvent survenir aux nouvelles dates de r\u00e9servation. Si le client souhaite annuler la r\u00e9servation, l&#8217;acompte re\u00e7u \u00e0 l&#8217;avance est non remboursable.<\/p><p>2.5. Par ce contrat, le Client accepte, d\u00e9clare et s&#8217;engage \u00e0 ce que s&#8217;il effectue\/souhaite apporter des modifications \u00e0 la r\u00e9servation pendant la p\u00e9riode d&#8217;inscription (p\u00e9riode de r\u00e9servation anticip\u00e9e, etc.) Le Client a accept\u00e9 que les remises sp\u00e9ciales ne soient pas valables pour les modifications de r\u00e9servation effectu\u00e9es en dehors des p\u00e9riodes pendant lesquelles les remises sp\u00e9ciales sont appliqu\u00e9es lors de l&#8217;inscription.<\/p><p>2.6. Apart r\u00e9pondra \u00e0 la demande de changement du client dans le d\u00e9lai en fonction de la disponibilit\u00e9 de l&#8217;appartement.<\/p><p>2.7. Il y aura au moins un client de plus de 18 ans dans la chambre de l&#8217;appartement. Les personnes de moins de 18 ans peuvent s\u00e9journer, \u00e0 condition qu&#8217;elles soient accompagn\u00e9es d&#8217;au moins un adulte.<\/p><p>2.8. En dehors du nombre de personnes sp\u00e9cifi\u00e9, les invit\u00e9s ne seront pas accept\u00e9s dans l&#8217;appartement. Si cette r\u00e8gle n&#8217;est pas respect\u00e9e, le client sera tenu responsable des situations criminelles qui pourraient survenir.<\/p><p>2.9. Le client est r\u00e9put\u00e9 avoir d\u00e9j\u00e0 accept\u00e9 les frais suppl\u00e9mentaires sur https:\/\/www.daphnepera.com\/apartments\/.<\/p><p>3. MODE DE PAIEMENT<\/p><p>3.1. Le client qui s\u00e9journera dans l&#8217;appartement doit payer 10% du co\u00fbt de l&#8217;h\u00e9bergement \u00e0 titre d&#8217;acompte lors de la demande de r\u00e9servation. Les frais d&#8217;h\u00e9bergement restants seront pay\u00e9s au moment de l&#8217;entr\u00e9e dans l&#8217;appartement.<\/p><p>3.2. La facture sera remise au Client \u00e0 la sortie de l&#8217;Appartement apr\u00e8s r\u00e9ception de la prestation. Apart ne pourra \u00eatre tenu responsable de la non r\u00e9ception de la facture.<\/p><p>4. RETOUR DE PAIEMENT ET ANNULATION<\/p><p>4.1. Dans le cas o\u00f9 le client envoie la demande d&#8217;annulation \u00e0 l&#8217;Appartement avec l&#8217;une des m\u00e9thodes de l&#8217;article 2.2, 20 (vingt) jours avant la date d&#8217;entr\u00e9e dans l&#8217;Appartement, la r\u00e9servation est annul\u00e9e \u00e0 condition que l&#8217;acompte vers\u00e9 ne soit pas rembours\u00e9. Le client a irr\u00e9vocablement accept\u00e9 et d\u00e9clar\u00e9 avoir pay\u00e9 cette somme \u00e0 Apart \u00e0 titre de clause p\u00e9nale. Si la taxe sur la valeur ajout\u00e9e est requise pour les clauses p\u00e9nales et autres indemnit\u00e9s \u00e0 payer par le client en vertu du pr\u00e9sent contrat, le client est tenu de payer la taxe sur la valeur ajout\u00e9e applicable.<\/p><p>5. H\u00c9BERGEMENT<\/p><p>5.1. L&#8217;\u00e2ge et l&#8217;identit\u00e9 du Client et des personnes accompagnantes seront v\u00e9rifi\u00e9s lors de l&#8217;enregistrement. Le client accepte, d\u00e9clare et assume par avance les responsabilit\u00e9s l\u00e9gales pouvant d\u00e9couler de la fourniture d&#8217;informations erron\u00e9es par le client. Le Client couvrira \u00e9galement les frais pouvant survenir du fait de cette situation.<\/p><p>5.2. En cas de d\u00e9t\u00e9rioration des objets \u00e0 l&#8217;int\u00e9rieur pendant le s\u00e9jour, le client devra en r\u00e9gler les frais au moment du d\u00e9part. Le client est r\u00e9put\u00e9 avoir d\u00e9j\u00e0 accept\u00e9 les frais suppl\u00e9mentaires sur https:\/\/www.daphnepera.com\/apartments\/.<\/p><p>5.3. Le client, quelle que soit l&#8217;heure \u00e0 laquelle il arrive \u00e0 l&#8217;appartement, s&#8217;installera dans la chambre au plus t\u00f4t \u00e0 15h30 le jour de l&#8217;entr\u00e9e dans l&#8217;appartement en raison de la pand\u00e9mie, et qu&#8217;il sortira \u00e0 11h00 au au plus tard, quelle que soit l&#8217;heure \u00e0 laquelle il quittera l&#8217;appartement, et le suppl\u00e9ment qui lui sera remis apr\u00e8s avoir quitt\u00e9 la chambre s&#8217;engage \u00e0 r\u00e9gler la prestation.<\/p><p>5.4. Les animaux domestiques ne seront pas accept\u00e9s par Apart.<\/p><p>5.5. Si le client renonce au service pour une raison autre que de ne pas remplir les responsabilit\u00e9s de l&#8217;appartement apr\u00e8s s&#8217;\u00eatre install\u00e9 dans l&#8217;appartement, le paiement ne sera pas rembours\u00e9.<\/p><p>5.6 En cas de violation par le client d&#8217;un article du contrat, il accepte et s&#8217;engage \u00e0 couvrir tous les types de dommages subis par l&#8217;appartement du fait de la violation.<\/p><p>5.7.Apart peut modifier les termes et conditions du service d&#8217;h\u00e9bergement en fonction des conditions saisonni\u00e8res et de la saison touristique.<\/p><p>6. AUTRES DISPOSITIONS<\/p><p>6.1. Les conditions impr\u00e9visibles telles que conditions m\u00e9t\u00e9orologiques d\u00e9favorables, gr\u00e8ve-lock-out, terrorisme, action militaire, inondation, incendie, etc. seront consid\u00e9r\u00e9es comme des cas de force majeure. Si de telles situations se produisent, l&#8217;appartement peut ne pas continuer \u00e0 servir.<\/p><p>6.2 Le Client accepte, d\u00e9clare et s&#8217;engage \u00e0 ce que les tribunaux de district soient comp\u00e9tents pour la r\u00e9solution des litiges survenant conform\u00e9ment au pr\u00e9sent contrat.<\/p><p>6.3. S\u00d6ZLE\u015eME KONUSU<\/p><p>1.1. \u0130\u015fbu s\u00f6zle\u015fme uyar\u0131nca Apart, M\u00fc\u015fterinin talebi \u00fczerine Apartta konaklama hizmetini sunmakla y\u00fck\u00fcml\u00fcd\u00fcr (ileride \u2018Hizmet\u2019olarak an\u0131lacak).<\/p><p>1.2. \u0130\u015fbu s\u00f6zle\u015fmenin imzalanmas\u0131yla(M\u00fc\u015fteri, Apartta konaklamak ve\/veya apart\u0131n sundu\u011fu hizmetler i\u00e7in rezervasyon yapt\u0131rarak i\u015fbu s\u00f6zle\u015fmeyi imza etti\u011fini kabul etmektedir)birlikte M\u00fc\u015fteri, apartta konaklama kurallar\u0131, rezervasyon kurallar\u0131 ile tarifeleri hakk\u0131nda bilgilendirildi\u011fini teyit etmektedir.<\/p><p>1.3. Apart, M\u00fc\u015fteri\u2019nin talebini teyid etti\u011finde (Rezervasyon Onayland\u0131\u011f\u0131nda) Taraflar, \u0130\u015fbu s\u00f6zle\u015fmeyi akdetmi\u015f olacaklard\u0131r.<\/p><p>2. KONAKLAMA REZERVASYONUNUN \u015eEKL\u0130<\/p><p>2.1. Hizmet rezervasyonu, M\u00fc\u015fterinin www.daphnepera.com internet sayfas\u0131ndaki rezervasyon formunu doldurup, %10 deposito bedelini \u00f6deyerek g\u00f6ndermesi ile DAPHNE PERA m\u00fcsaitlik durumuna g\u00f6re ger\u00e7ekle\u015ftirilebilir.<\/p><p>2.2. M\u00fc\u015fteri talebini feshetmek veya herhangi bir de\u011fi\u015fiklik yapmak istedi\u011fi durumda i\u015fbu s\u00f6zle\u015fmede belirlenen hususlara uymak ve \u015fartlar\u0131 yerine getirmek kayd\u0131yla +90 533 276 45 18 numaral\u0131 telefondan aparta ba\u015fvurabilir, kahramangunaydin@gmail.com mail adresine e-posta g\u00f6nderebilir ya da Apart web sitesi \u00fczerinden whatsap online m\u00fc\u015fteri temsilcilerine \u015fahsen ba\u015fvurabilir.<\/p><p>2.3. M\u00fc\u015fterinin, Rezervasyonunda de\u011fi\u015fiklik yapma talebinin en ge\u00e7, konaklaman\u0131n ba\u015flang\u0131\u00e7 tarihinden 20 (yirmi) g\u00fcn \u00f6nce M\u00fc\u015fteri taraf\u0131ndan 2.2. maddesinde belirtilen y\u00f6ntemlerden biri ile aparta iletilmesi gerekmektedir.<\/p><p>2.4. M\u00fc\u015fteri rezervasyonu i\u00e7in 1 defaya mahsus m\u00fcsaitlik durumuna g\u00f6re tarih de\u011fi\u015fiklik talebinde bulunabilir. M\u00fc\u015fteri, Yeni rezervasyon tarihlerinde olu\u015fabilecek fiyat farklar\u0131n\u0131 kabul etmek durumundad\u0131r. Apart odas\u0131nda en az bir 18 ya\u015f \u00fczeri m\u00fc\u015fteri olacakt\u0131r. 18 ya\u015f alt\u0131ndakiler en az bir yeti\u015fkin yan\u0131nda olmak ko\u015fulu ile konaklayabilirler.<\/p><p>2.8. Aparta belirtilen ki\u015fi say\u0131s\u0131 d\u0131\u015f\u0131nda misafir kabul edilmeyecektir. \u015eayet bu kurala uyulmad\u0131\u011f\u0131 takdirde olu\u015fabilecek cezai durumlardan m\u00fc\u015fteri sorumlu tutulacakt\u0131r.<\/p><p>2.9. https:\/\/www.daphnepera.com\/apartments\/ adresinde yer alan ek \u00fccretlendirmeleri m\u00fc\u015fteri \u015fimdiden kabul etmi\u015f say\u0131l\u0131r.<\/p><p>3. \u00d6DEME \u015eEKL\u0130<\/p><p>3.1. Apartta konaklayacak M\u00fc\u015fteri, rezervasyon ba\u015fvurusu s\u0131ras\u0131nda konaklama bedelinin %10&#8217;unu deposito olarak \u00f6demek durumundad\u0131r. Kalan konaklama bedeli apart&#8217;a giri\u015f an\u0131nda \u00f6denecektir.<\/p><p>3.2. Fatura, M\u00fc\u015fteriye hizmeti ald\u0131ktan sonra Apart \u00e7\u0131k\u0131\u015f\u0131 esnas\u0131nda verilecektir. Faturan\u0131n al\u0131nmamas\u0131ndan Apart sorumlu tutulamayacakt\u0131r.<\/p><p>4. \u00d6DEMEN\u0130N \u0130ADE \u015eEKL\u0130 ve \u0130PTALLER<\/p><p>4.1. M\u00fc\u015fterinin iptal talebini Aparta giri\u015f tarihinden 20 (yirmi) g\u00fcn \u00f6nce 2.2.maddesindeki y\u00f6ntemlerden biri ile Aparta iletmesi halinde, yapm\u0131\u015f oldu\u011fu depozito \u00f6demesi iade edilmemek \u015fart\u0131 ile rezervasyonu iptal edilir. M\u00fc\u015fteri bu tutar\u0131 Aparta cezai \u015fart olarak \u00f6dedi\u011fini geri d\u00f6n\u00fclemez olarak kabul ve beyan etmi\u015ftir. \u0130\u015f bu s\u00f6zle\u015fme gere\u011fince M\u00fc\u015fterinin \u00f6deyece\u011fi cezai \u015fart ve di\u011fer tazminatlar i\u00e7in katma de\u011fer vergisi \u00f6denmesi gerekti\u011fi takdirde m\u00fc\u015fteri y\u00fcr\u00fcrl\u00fckteki katma de\u011fer vergisini \u00f6demek mecburiyetindedir.<\/p><p>5. M\u00fc\u015fteri, aparta vard\u0131\u011f\u0131 saat ka\u00e7 olursa olsun, pandemi nedeniyle aparta giri\u015f g\u00fcn\u00fc en erken saat 15:30\u2019da odaya yerle\u015fece\u011fini ve apartta \u00e7\u0131kaca\u011f\u0131 saat ka\u00e7 olursa olsun en ge\u00e7 saat 11:00\u2019de odadan \u00e7\u0131k\u0131\u015f yapaca\u011f\u0131n\u0131, odadan \u00e7\u0131k\u0131\u015f yapt\u0131ktan sonra kendisine verilecek ek hizmetin bedelini \u00f6deyece\u011fini kabul etmi\u015ftir.<\/p><p>5.4. Evcil hayvanlar Apart taraf\u0131ndan kabul edilmeyecektir.<\/p><p>5.5. M\u00fc\u015fterinin aparta yerle\u015ftikten sonra apart\u0131n sorumluluklar\u0131n\u0131 yerine getirmemesi d\u0131\u015f\u0131nda bir sebepten dolay\u0131 hizmetten vazge\u00e7mesi durumunda yap\u0131lan \u00f6deme iade edilmeyecektir.<\/p><p>5.6.M\u00fc\u015fterinin, s\u00f6zle\u015fmenin herhangi bir maddesini ihlal etmesi durumunda, yapm\u0131\u015f oldu\u011fu ihlal sonucu apart\u0131n u\u011frad\u0131\u011f\u0131 her t\u00fcrl\u00fc zarar\u0131 kar\u015f\u0131lamay\u0131 kabul ve taahh\u00fct eder.<\/p><p>5.7.Apart, mevsim \u015fartlar\u0131 ve turizm sezonuna g\u00f6re konaklama hizmetinin \u015fart ve ko\u015fullar\u0131n\u0131 de\u011fi\u015ftirebilir.<\/p><p>6. D\u0130\u011eER H\u00dcK\u00dcMLER<\/p><p>6.1. Olumsuz hava \u015fartlar\u0131, grev-lokavt, ter\u00f6r, askeri harekat, sel, yang\u0131n v.b.tahmin edilemeyecek durumlar m\u00fccbir sebepler olarak kabul edilecektir.
